In an uncontested divorce, separating couples have already decided and agreed on all the issues related to the case. These issues include the custody of minor children, division of real and personal property, and alimony. An uncontested divorce can often be handled without a court appearance. Olah Family Law will represent the filing party and ensure all the documents are filed, make corrections if required by the court and ensure the client receives a final copy of the divorce decree.  An uncontested divorce may be handled on an hourly or flat fee basis.

On the other hand, a divorce is contested when the parties involved do not agree on all the issues related to the case. In a contested divorce, the firm will require a retainer from the client and will bill against that retainer until the process is complete. Depending on the length of the process, additional retainer funds may be required. Any funds remaining on retainer will be refunded to the client once a final decree is issued.

After parties have worked within the terms of a settlement agreement or court order, one party may want to modify those terms. The firm can help clients determine when a modification is appropriate, representing the modification or defending against the modification. Olah Family law represents the client through the legal process.  A modification case is billed hourly and requires a retainer.

The firm will assist you with other family-law matters, including  establishing paternity, child support issues, child custody matters not related to divorce, dependency defense, and pre-nuptial and/or post-nuptial agreements.

Mediation is an excellent option when the parties involved want to attempt to settle their case outside of the Courts. Some courts will order parties involved in domestic relations litigation to attempt mediation before the matter can be set for a final hearing.

This form of Alternative Dispute Resolution is a valuable tool that can be used to help parties resolve many kinds of disputes.  The process often results in a quicker resolution than proceeding to a final hearing in court. Mediation can be initiated before or after a complaint is filed.
