In an uncontested divorce, separating couples have already decided and agreed on all the issues related to the case. These issues include the custody of minor children, division of real and personal property, and alimony. An uncontested divorce can often be handled without a court appearance. An uncontested divorce may be handled on an hourly or flat fee basis.
On the other hand, a divorce is contested when the parties involved do not agree on all the issues related to the case. In a contested divorce, the firm will require a retainer from the client and will bill against that retainer until the process is complete. Depending on the length of the process, additional retainer funds may be required. Any funds remaining on retainer will be refunded to the client once a final decree is issued.
