In an uncontested divorce, separating couples have already decided and agreed on all the issues related to the case. These issues include the custody of minor children, division of real and personal property, and asset division. An uncontested divorce can often be handled without a court appearance. Olah Family Law will provide you with a fixed price for preparing and filing the appropriate documents and monitoring the process through the final decree.

On the other hand, a divorce is contested when the parties involved do not agree on all the issues related to the case. In a contested divorce, the firm will require a retainer from the client and will bill against that retainer until the process is complete. Depending on the length of the process, additional retainer funds may be required. Any funds remaining on retainer will be refunded to the client once a final decree is issued.

After parties have worked within the terms of a settlement agreement or court order, one party may want to modify those terms. The firm can help clients determine whether or not a modification is appropriate and, when modification is appropriate, Olah Family law represents the client through the legal process.  A modification case is billed hourly and requires a retainer.

The firm will assist you with other family-law matters, including paternity, establishing paternity, child custody matters not related to divorce, pre-nuptial and/or post-nuptial agreements.

Olah Family Law understands the importance of preparing wills. A will allows you to create a record of your final wishes and ensures your estate is properly distributed. The firm works with clients in and around Huntsville to draft and execute wills and other estate planning documents such as a Power of Attorney and an Advanced Directive for Healthcare.

This form of Alternative Dispute Resolution often results in a quicker resolution to a contested family law issue. Mediation can also be less expensive than taking the matter to a final hearing through the courts. Mediation is available before and after a complaint is filed and is considered a valuable tool as it can be used to settle many kinds of disputes.

Mediation is an excellent option when the parties involved want to attempt to settle their case outside of the Courts. Some courts will order parties to mediation before the matter can be set for a final hearing. Olah Family Law represents clients in mediation as well as acting as the mediator mediator when not otherwise involved with either client in a family law matter.
